HOW TO VALIDLY EXERCISE THE RIGHT OF WITHDRAWAL

 

  • If you are a resident of a country in the European community or outside the EU, the cost of the return is charged to the customer.

Pursuant to the applicable legislation and the Conditions of Sale from
you accept at the time of purchase, the exercise of the right to
withdrawal is subject to the following conditions:
Within 28 (twenty-eight) days of receipt of the product subject to
return, this form, correctly completed, must
be sent by e-mail to customercare@displaj.it. The first
change is free and paid by the company by carrier
commissioned by the latter. Shipping costs related to exchanges
subsequent to the first will instead be charged to the customer.
2) Within 14 (fourteen) days from the date on which you communicated to
Seller your decision to withdraw from the contract is necessary
transcribe all the information in this form and deliverthe product/s being returned, together with this form
complete with all voices, DI. PEN. s.r.l. at the address in Via
Castelgandolfo, 14 ch. 80013 – Casalnuovo di Napoli (NA) ITALY,
or to the carrier in charge of the return indicated by the Seller
(DISPLAY). If the return is being sent back using a courier
otherwise, all costs will be borne by the customer.
3) In case of return of multiple products, they must be returned
to DI. PEN. s.r.l. in the same condition in which they were received and/or
with the same shipment.
It is also necessary that:
a) the product is intact and complete with the safety thread present
on articles;
b) the product is returned in its original packaging;
c) each garment must be returned with all labels and tags
attached, including all original packaging and accessories
(dustbags, hangers, coat covers, etc.) received with the order;
d) the garments must not have been worn, washed or altered and not
they must show no signs of use;
e) the items must be packed in an appropriate manner, in the
same way they were received;
f) the return is accompanied by the form referred to in point 1. Against the
legitimate exercise of the right of withdrawal, DISPLAJ will
refund you the price of the returned product, including the cost
of the first shipment, within 14 (fourteen) days or to provide a
DISCOUNT CODE equivalent to the amount of the returned item.
g) returns authorized by DISPLAJ must be shipped by DISPLAJ
country where the original order was delivered.
RIGHT OF WITHDRAWAL
In compliance with the art. 52 of Legislative Decree 6 September 2005 n.
206 (the "Consumer Code"), you have the right to withdraw from the contract
signed with DI. PEN. s.r.l. (the “Seller” or “DISPLAJ”) without
any penalty and without having to provide any reason, within 28
days from the day you received the products purchased on displaj.it.
In compliance with the art. 54 of the Consumer Code, you can exercise the
right of withdrawal using, at your choice, one of the following
mode:
a) online transmission to the Seller via email:
customercare@displaj.it of the Return Form that you find attached,
completed in full; in this case, the Seller will send you
confirmation by e-mail of receipt of the
declaration of withdrawal;
b) sent by post to the Seller in compliance with the standard form aipursuant to art. 49, paragraph 4, of the Consumer Code, to be completed
fully;
c) sending another explicit declaration by post to the Seller
of your decision to withdraw from the contract. In cases b) and c) yours
declaration must be sent to the attention of Customer Service
at: DI. PEN. s.r.l. at the address in Via Castelgandolfo, 14 chap.
80013 – Casalnuovo di Napoli (NA) ITALY in such cases, it will be up to you
I bear the burden of proving the correct and timely exercise of the right of withdrawal.
In compliance with the art. 57 of the Consumer Code, once
exercised the withdrawal from the contract, the products to be returned must
be delivered to the carrier within fourteen (14) days from the date
in which you communicated to the Seller your decision to withdraw from the
contract.
1. Conditions for exercising the right of withdrawal in compliance
to art. 52 of the Consumer Code
The right of withdrawal is understood to be exercised correctly if they are
fully respected the following conditions: a) the right of withdrawal
must be regularly exercised within twenty-eight (28) days from
receipt of the products following one of the methods above
indicated;
b) the products must comply with the requirements indicated in art. 3 and
they must not have been used, worn and washed;
c) the identification tag must still be attached to the products
with the disposable seal which forms an integral part;
d) the product is returned in its original packaging;
e) each garment must be returned with all labels and tags
attached, including all original packaging and accessories
(dustbags, hangers, coat covers, etc.) received with the order;
f) the garments must not have been damaged and must not
show no signs of use;
g) the items must be packed in an appropriate manner, in the
same way they were received;
h) the return is accompanied by the return form and complete with in
all of his entries received by DISPLAJ.
i) returns authorized by DISPLAJ must be shipped by DISPLAJ
country where the original order was delivered.
l) returned products must be delivered to the shipper by
fourteen (14) days starting from when you communicated to
Seller your decision to withdraw from the contract;
If you have complied with all the required conditions, the Seller, in
compliance with art. 56 of the Consumer Code, will reimburse you
the full price of the products purchased, remaining at your expense
only the costs of the return, i.e. those for the return
to the Seller of the products purchased, unless the Seller has you
expressly exempt from such expenses at the time of purchase
and on the further condition that you make use of the forwarder e
of the shipping methods suggested by the Seller in the following
paragraph 2. 2. How to return the products to the Seller
The Seller suggests using the GLS forwarder
(https://www.gls-italy.com/) for the return of purchased products.
If you decide to use GLS for shipping and to serve yourself
return address label - included in the package
containing the purchased products, you will not have to carry out the first
person to pay the return costs. It will in fact be the Seller
to pay the courier on your behalf, deducting a
lump sum equal to the cost previously incurred for the
delivery of the purchased products to your home. This method of
shipment also allows you to check, at any time, where
find each package, freeing you from any responsibility in case
of loss or damage to the products during transport.
In case you decide to use a forwarder instead
other than GLS you will have to make the payment in person
of the costs of the return and you will remain responsible in the event
of loss or damage to the products during transport.
It is understood that, in accordance with art. 56, paragraph 2, of the Code of
Consumption, any additional costs will not be reimbursed
incurred by you for having chosen a type of shipment e
different and/or faster delivery than the standard one.
3. Conformity checks of returned products
You will be contacted if your return cannot be accepted because
does not comply with the conditions set out in art. 1 or in the case of which
to art. 59 of the Consumer Code and you can choose to get back the
products purchased at your expense. In case you refuse this
shipment the Seller reserves the right to withhold the products e
the amount corresponding to the purchase price of the products.
All products must be returned new and unused, in perfect condition
conditions, with all protective materials and identification tags
and stickers attached to the products, as well as their packaging, the
accessories and documentation. The Seller reserves the right to
not accept the return or reduce the amount of the refund or the
exchange for another item if the product shows signs of use or if it is
been used or altered from its original condition.
The Seller may make a reduction of the refund in the
following circumstances: • the products have been used, worn,
damaged or washed; • the identification tag is no longer attached to the
products with the disposable seal or has not been returned. Please
note that the identification tag is an integral part of
each product; • the original packaging has not been returned
it is an integral part of the product (e.g. the protective bag);
You will be contacted if the Seller decides to reduce the refund. In
this case, you can choose, as an alternative to the reduction of the
refund, to get the purchased products back at your expense. In this
last case, if you refuse the shipment, the Seller will have
right to withhold the products and the amount indicated for the deduction
of the refund, due to the decrease in value of the returned products.
The Seller assumes no responsibility in the case of products
returned by mistake.
4. Refund times and methods
After the Seller has received your return and checked that all
the requirements have been met, you will receive a confirmation e-mail
acceptance of the return and DISPLAJ will proceed with the full refund,
or, if the existence of a decrease of
value of the returned products, you will receive an e-mail in which you will be
communicated the amount deducted by way of reduction of the refund
and DISPLAJ will refund the amount due. Whatever
both the payment method you used among those available, the
refund is activated by the Seller as soon as possible, e
however within fourteen (14) days from the date on which it came to
knowledge of the exercise of your right of withdrawal, once
verified that the withdrawal took place in compliance with the conditions
listed above.
The effective time for the re-credit or return of sums from
you pay for the purchase of the products depends on the methods of
payment used:
• purchase via PayPal the refund will be made to your account
PayPal and will be immediately visible. The actual refund on the
credit card from your PayPal account depends on which institution it has
issued the card;
• credit/debit card purchase: repayment time depends
by the credit/debit card company
We remind you that the value date of the re-credit is the same
of the charge;
• cash on delivery (if available): refund
takes place on the current account indicated by you, therefore the time of
refund depends on the correctness of the data you enter;
normally the refund takes place within fourteen (14) days. In
in the case of a gift, the refund of the sums will be made towards
of who made the payment.
5. Products affected by defects or non-compliant
Without prejudice to the application of the mandatory rules for the protection of
consumer, you can return a product because it is affected by defects or not
compliant with what was ordered, informing the Seller, within twenty-eight
(28) days from the day you received the products purchased on
WWW.DISPLAJ.IT using the Return Form that you find in the area
Customer care.
DISPLAJ may reserve the right to request photographic evidence
before authorizing the return for defective goods.

DISPLAJ will check the products you have returned because they are affected by defects
or do not comply with the order and will proceed with the full refund,
including the shipping costs and expenses you incurred for
return the products to DISPLAJ.
In the event that DISPLAJ does not detect any defects or lack of conformity
in the returned products, you will be informed that your return cannot
be accepted and you can choose whether to get the purchased products back.
In case you refuse the shipment, DISPLAJ will have the right to
withhold the products and the amount corresponding to the purchase price
of the products, as well as reserves the right to request the costs incurred.
6. Conditions for the exchange of products
In some cases, as detailed below, you will have the option to
change the products purchased with others of the same model, having
different size and/or colour. The exchange of products will only be possible
if the products in the selected size and/or color are available
at the Seller's warehouses. The exchange request will take place in
limits set forth below:
a) you can request the exchange of one or more products purchased within and
no later than twenty-eight (28) days from the date of their delivery,
by completing the Return Form, to be sent
to DISPLAJ via email: customercare@displaj.it within the aforementioned
term. The products to be exchanged must be delivered to
courier within fourteen (14) days from when you have
communicated to the Seller your decision to change the products;
b) you can request the exchange of one or more purchased products only
with products of the same model, having different size and/or colour.
In any case, the options available for the exchange will be indicated in the
Return Form;
c) you can make only one exchange request for each product
purchased;
d) the products for which you request an exchange must be returned
to DISPLAJ in their original packaging, unused, neither
worn, washed or damaged, and the identification tag must
still be attached with the disposable seal;
e) the products to be exchanged that are part of a single order must
be sent to DISPLAJ in one shipment.
f) the products must comply with the requirements indicated in art. 3 and
they must not have been used, worn and washed;
g) the identification tag must still be attached to the products
with the disposable seal which forms an integral part;
h) the products to be exchanged must be returned in the packaging
original;
i) each garment must be returned with all labels and tags
attached, including all original packaging and accessories
(dustbags, hangers, coat covers, etc.) received with the order;
l) the items must be packed in an appropriate manner, in the same
how they were received;
m) the exchange is accompanied by the return form and completed in
all of his entries received by DISPLAJ. If all the conditions above
callbacks are properly honored once compiled
and sent the Return Form containing your request for
exchange, DISPLAJ will take charge of the same request for
replacement by sending you a confirmation email for this purpose. After
that DISPLAJ will have received the products you intend to exchange e
checked that all the above requirements have been met
respected, DISPLAJ will verify the actual availability at its own premises
warehouses of products in the size and/or color that you will have selected.
In the event that the product or products selected for exchange does not
are available in its warehouses, DISPLAJ cannot
accept your exchange request and will therefore proceed to
refund you the price of the product or products originally
purchased and non-replaceable, in accordance with the provisions of
Consumer Code and in the manner provided above. In the
in the event that the product or products selected for exchange are
available, DISPLAJ will be able to accept your exchange request and
will therefore proceed to send you an e-mail confirming the occurrence
shipment of replacement products. Shipping will take place in this
case within thirty (30) business days from the date on
which DISPLAJ will have become aware of your request for
exchange. Shipping charges for replacement products will be a
load of DISPLAJ.

Where the price of the purchased product is lower or higher
at the price of the product selected for exchange, it will not be yours
recognized any refund and/or charge for the difference. Stay
in any case provided that, as an alternative to the request for replacement of the
product, you can exercise your right of return in accordance with the
Consumer Code.
You will be contacted in case your exchange request cannot
be accepted because it does not comply with the conditions above
reported. In this case, you can choose to have the products back
you intended to change at your expense. In case you refuse this
shipment, DISPLAJ reserves the right to withhold the products and
he may also withhold the amount corresponding to the purchase price
of the products themselves, or the amount indicated for the deduction of the
refund, due to the decrease in value of the returned products,
according to the above.
The replacement product or products may be subject to
subsequent return pursuant to art. 52 of the Code of
Consumption. 7. Product identification tag
We remind you that all products offered for sale by the Seller are equipped with an identification tag fixed with a disposable seal,
which forms an integral part of the property. We therefore remind you of
test the product without removing the tag and relative seal,
because returned products without them will not be accepted.
8. Consumer Code
These Conditions for the exercise of the right of withdrawal, acting
an integral part of the General Conditions of Sale, are regulated
by Italian law and in particular by Legislative Decree 6
September 2005, no. 206.
